CITY OF MAYFIELD HEIGHTS
COUNCIL MEETING MINUTES
The regular meeting of Council was called to order at 7:35 P.M. by Council President Michael Ballistrea.
ROLL CALL: PRESENT: Mr. Michael Ballistrea, Mr. Anthony DiCicco, Mrs. Donna Finney, Mr. Ronald Kobunski, Mr. Sam Mercurio, Mr. David Sasak, Mrs. Diane Snider. ABSENT: None.
Also present were Mayor Gregory Costabile, Mr. Leonard Carr, Mr. Robert Tribby and Miss Lisa Benedetti.
The Pledge of Allegiance was said.
Mr. Mercurio moved to suspend reading of the Council minutes of April 28, 2008, and approve as written, seconded by Mrs. Finney. All in favor, motion carried. Minutes approved.
CORRESPONDENCE AND ANNOUNCEMENTS:
Mr. Ballistrea stated that when he ran for Council the last time, one of his goals was to have a Charter review. He is now in the process of organizing a committee and would like to have residents on it. He is hoping to post the information on the City's website and cable station.
REPORTS OF OFFICERS:
Mayor Costabile: The Mayor wished all the mothers a Happy Mother's Day and expressed his thanks for all they do.
Mayfield Road Update: Everything continues to be on schedule. Routine reports are received by the City. The northeast corner of Mayfield and SOM Center has been completed and they are now working on the northwest corner. The Police Department continues to work that intersection of the project to help with traffic flow during peak hours.
A meeting was held with the City Engineer and the Service Director to discuss the 2008 road program. The Public Works and Services Committee then met to review it and will report on it. The Mayor supports the recommendations.
The Mayor is continuing to work with AT & T regarding getting P.E.G. channels for its U-verse customers set up. The City needs to upgrade equipment on its side to coordinate this process for its portion of the information.
The Mayor attended the Golden Agers Club meeting and enjoyed meeting with the members and discussing items.
Gas well installation continues to be done around the City. The latest one is going to be drilled in the corporate park area on the west side of Lander Road just past the I271 overpass. Again, the Mayor is requesting that the State representatives review HB 278, which took away home rule regarding this matter, and allow the municipalities to determine the best locations for these wells. The pooling issue should also be addressed. He will send a letter to the State Senate President and Speaker of the House.
Retired Detective Sergeant Larry McHugh passed away. He was a long time employee of the City from 1956 until 1990. Condolences go out to the family.
The Hillcrest Hospital expansion ground breaking was May 8, 2008. The City is fortunate to have a first class facility like Hillcrest. The expansion should add approximately 100 full time jobs that will continue to add to the Mayor's Economic Development Plan for the City.
The Mayor noted that May is National Military Appreciation Month and National Skin Cancer Awareness Month.
May 17, 2008 the Mayor's Community Council will be doing a spring cleanup project. They are looking for residents who need help. The fall cleanup was greatly appreciated.
May 26, 2008 there will be a Memorial Day Ceremony. All residents were urged to attend to honor those who have served their country.
May 31, 2008 the Recreation Commission will be holding a Taste of Italy fundraising event. Tickets are available at City Hall. It promises to be a fun evening giving all the chance to catch up with current friends and meet new friends in the community. All proceeds will be used to further advance Recreation activities for all residents.
Director of Law Carr: Mr. Carr stated that to add to the Mayor's comments about the gas well situation, there are others going in at Coppertree Apartments and Gates Mills Towers. Hillcrest Hospital may also be part of one or more wells.
Director of Finance Tribby: No report.
REPORTS OF COMMITTEES, COMMISSIONS AND BOARDS:
Building Committee: No report.
Finance and Audit Committee: Mr. Mercurio stated that a meeting has been scheduled for May 19, 2008 at 1:00 P.M. to review the energy audit report.
Legislative Committee: No report.
Public Works and Services Committee: Mr. Kobunski reported on the meeting held May 8, 2008. Copies of the minutes of the meeting were mailed to all members and are a part of the permanent record.
Recreation and Parks Committee: Mrs. Snider reported that a community days volunteer meeting was held last week and monthly meetings will be held on the first Tuesday of the month. The committee is still looking for volunteers and any one interested can contact the Recreation Department.
The next meeting of the Recreation and Parks Committee is May 27, 2008.
Safety and Transportation Committee: No report.
Board of Zoning Appeals: Mr. Kobunski reported that the next meeting is May 13, 2008.
Commission on Aging: Mr. Ballistrea reported on the meeting held May 6, 2008. Copies of the minutes of the meeting were mailed to all members and are a part of the permanent record.
Planning Commission: Mr. Sasak reported on the meeting held May 5, 2008. Copies of the minutes of the meeting were mailed to all members and are a part of the permanent record. ----------------------------------------------------------------------------------------------------------------------
PUBLIC COMMENT:
Rhonda Farkosh, 1283 Sunset Road, stated she has lived in the City for 17 years. She lives next to rental property and has complained about it, but did not receive any satisfaction. The fence is falling down and has nails sticking out of it, there is mold on the house, and the driveway and sidewalks are crumbling. There are safety issues here. She stated that she received a notice several years ago that the City would be conducting visual inspections on all houses, but these problems have not been addressed. She is a proud homeowner and takes care of her property and believes all the properties should be taken care of whether or not they are rentals. It is for the good of the whole neighborhood. She asked that something be done. The building inspectors have been out and she felt more could have been done. Mrs. Farkosh was told that Council and the Mayor would investigate the matter and get back to her.
David Deneke, 6251 Mayfield Road, asked for Council's support of the Board of Zoning Appeals and Planning Commission decisions. ---------------------------------------------------------------------------------------------------------------------- RESOLUTION NO. 2008-34: "A Resolution congratulating Hillcrest Meals on Wheels on its 25th Anniversary." Mr. Carr read the resolution by title only. Mrs. Snider moved for suspension of the rules, seconded by Mr. Mercurio. Roll Call on motion as stated: AYES: Finney, Mercurio, Snider, Kobunski, Sasak, DiCicco, Ballistrea. NAYS: None. Motion carried. Mr. Kobunski moved for adoption, seconded by Mr. DiCicco. Mayor Costabile read the resolution in its entirety and the various members present were congratulated, especially the volunteers. Mr. Ballistrea mentioned that volunteers are always needed for this worthy organization. The resolution is adopted.
RESOLUTION NO. 2008-35: "A Resolution proclaiming May 2008 as "National Military Appreciation Month." Mr. Carr read the resolution by title only. Mr. Kobunski moved for suspension of the rules, seconded by Mr. Sasak. Roll Call on motion as stated: AYES: Sasak, Kobunski, DiCicco, Finney, Mercurio, Snider, Ballistrea. NAYS: None. Motion carried. RESOLUTION NO. 2008-37: "A Resolution authorizing the Mayor to execute Supplemental Agreement #3 with HNTB Corporation to provide construction support services for the Mayfield Road Corridor Project." Mr. Carr read the resolution by title only. Mr. Mercurio moved for suspension of the rules, seconded by Mrs. Finney. Roll Call on motion as stated: AYES: Finney, Mercurio, Snider, Kobunski, Sasak, DiCicco, Ballistrea. NAYS: None. Motion carried. Mr. Kobunski moved for adoption, seconded by Mr. DiCicco. Mr. Ballistrea stated a memo was received from Mr. Tribby with a letter from HNTB explaining the matter. Mayor Costabile further explained that HNTB is one of the initial design engineers of the project. They continue to be helpful when questions arise. The initial authorized amount has been used and this allows additional funds to continue to use the company. All invoices will be reviewed by our City Engineer prior to approval. RESOLUTION NO. 2008-38: "A Resolution approving a lot consolidation, which consolidates Parcel Nos. 862-01-005, 862-01-006 and 862-01-007 to create one parcel in conjunction with the construction of a new restaurant building (Burger King, 6251 Mayfield Road)." Mr. Carr read the resolution by title only. Mr. Kobunski moved for suspension of the rules, seconded by Mrs. Snider. Roll Call on motion as stated: AYES: Sasak, Kobunski, DiCicco, Finney, Mercurio, Snider, Ballistrea. NAYS: None. Motion carried. Mrs. Finney moved for adoption, seconded by Mr. Mercurio. The resolution is adopted. ---------------------------------------------------------------------------------------------------------------------- ORDINANCE NO. 2008-12: "An Ordinance amending Chapter 1339, Section 1339.02, of the Codified Ordinances of the City of Mayfield Heights pertaining to point of sale inspections." Mr. Carr read the ordinance by title only. Mr. Kobunski moved for suspension of the rules, seconded by Mr. DiCicco. Roll Call on motion as stated: AYES: Kobunski, Snider, Finney, Mercurio, DiCicco, Sasak, Ballistrea. NAYS: None. Motion carried. Mr. DiCicco moved for adoption, seconded by Mrs. Finney. Mr. Ballistrea stated he spoke with Building Director Tom Jamieson and he understands that the Director either spoke or left a message for all Council members. This change allows a point of sale inspection to be valid for one year instead of only six months. It is similar to many municipalities. Roll Call on motion as stated: AYES: DiCicco, Mercurio, Sasak, Kobunski, Finney, Snider, Ballistrea. NAYS: None. Motion carried. The ordinance is adopted. ---------------------------------------------------------------------------------------------------------------------- Mr. Sasak, seconded by Mr. DiCicco, moved to confirm the decision of the Planning Commission approving the final site plan for a new 2,672 sq. ft. restaurant building for Burger King at 6251 Mayfield Road. Mr. Sasak stated that the only change was the removal of the dead-end lane at the back of the property and this was done at the City's request. All in favor, motion carried. ---------------------------------------------------------------------------------------------------------------------- Mr. Mercurio, seconded by Mr. Kobunski, moved to authorize payment of $16,677.53 to Great Lakes Petroleum Company for gasoline for various departments. All in favor, motion carried. ---------------------------------------------------------------------------------------------------------------------- Mr. Mercurio, seconded by Mr. Sasak, moved to authorize a contribution of $3,000 to support the Schnurmann House Nutritional Program. Mr. Ballistrea stated that the City has previously supported both the nutrition program and the purchase of a van. Mayor Costabile explained that this program is open to all residents of Mayfield Heights, not just the Schnurmann House residents, which is why the City is supporting the program. Funding for these types of programs is getting harder to find and many of the area municipalities are also contributing. All in favor, motion carried. ---------------------------------------------------------------------------------------------------------------------- Mrs. Snider, seconded by Mr. Kobunski, moved to advertise for bids for the 2008 road program. Mr. Kobunski reported that some of the streets are in urgent need of repair. Mayor Costabile added that because of the Mayfield Road project, the City did not do as many streets last year as normal. This year 43 of the 98 streets in the City will have some work done on them as the City Engineer and Service Director have made some cost efficient suggestions. Mr. Kobunski thanked both men for their efforts. Mrs. Finney inquired when Golden Gate Shopping Plaza would be starting its parking lot work. The parking lot is getting quite bad. Mayor Costabile replied that the management is trying to work out some issues with a few of the tenants and hopes to get started soon.
